Background Checks: How to Hire Honest, Qualified Employees—Without Breaking the Law in the Process
Employer Resource Institute Audio Conference
Originally presented on May 10, 2007
What you don't know about your employees and job candidates can hurt you down the road.
Bausch & Lomb and Radio Shack recently suffered tremendously negative publicity when their chief executive officers admitted claiming college degrees on their resumes that they'd never earned. A Texas company hired a truck driver without checking his background—which included five speeding tickets over the previous 18 months; one week into his new job, the driver hit several cars in an accident, and the employer lost $500,000 in the lawsuits that followed.
One nationwide employee screening service says it's found discrepancies or problems in a whopping 49 percent of the workers and applicants it checks for employers.
Before you rush into checking employee and applicant backgrounds, though, you must know the rules. You can legally conduct searches and investigations only within specific constraints, and there is data you may never use in background checks, even if a worker or job candidate volunteers it. You need to know how to properly respond when your search turns up potentially troubling information, and how to avoid lawsuits brought by the disgruntled applicants you decide not to hire based on their background check results.
Join us on May 10 for this 90-minute audio conference that will give you practical advice for conducting effective (and legal) background checks. Our expert will share the key dos and don'ts for hiring honest, qualified workers without exposing yourself to claims of negligent hiring or discrimination.
And, at the end of the call, you'll have the chance—via phone or email—to pose your own specific questions about background checks.
YOU AND YOUR COLLEAGUES WILL LEARN:
- The major types of employment background checks, from criminal records searches and civil litigation checks to educational background, job history, and Social Security verifications
- Which workers and applicants aren't appropriate targets for background checks
- What types of information you can legally request in your background checks
- The special rules governing credit report information
- Why certain information must be considered off limits, even if an employee or job candidate volunteers it to you
- Your options if the background check reveals negative information
- What you're legally required to tell an employee or applicant, both before and after the search
- How (and if) you should file or dispose of background check results
